Well, that’s exactly what this man did, and his caffeine addiction ended up getting him caught. According to the news report, a man wearing a fedora hat walked into a bank and approached a teller. He placed a BB-gun on the counter and told the teller to give him money. He left the bank with $4,000 and apparently decided he deserved a coffee break. Just a block away, he stopped at a Dunkin’ Donuts and was spotted by a police officer who had heard about the incident and was searching for a man matching that description. After talking to the man, the officers found the BB-gun as well as the money. He is now charged with Aggravated Robbery – an extraordinary risk crime in Weld, Logan, and Morgan County.

Robbery – C.R.S. 18-4-301 – is charged when a person takes something of value from another person or in the presence of another person using force, threats, or intimidation. The law has decided if certain factors are present during the Robbery, the charge can be worsened to Aggravated Robbery.

C.R.S 18-4-302 – Aggravated Robbery is defined by Colorado law as:

A person who commits robbery is guilty of aggravated robbery if during the act of robbery or immediate flight therefrom:

  1. He is armed with a deadly weapon with intent, if resisted, to kill, maim, or wound the person robbed or any other person; or
  2. He knowingly wounds or strikes the person robbed or any other person with a deadly weapon or by the use of force, threats, or intimidation with a deadly weapon knowingly puts the person robbed or any other person in reasonable fear of death or bodily injury; or
  3. He has present a confederate, aiding or abetting the perpetration of the robbery, armed with a deadly weapon, with the intent, either on the part of the defendant or confederate, if resistance is offered, to kill, maim, or wound the person robbed or any other person, or by the use of force, threats, or intimidation puts the person robbed or any other person in reasonable fear of death or bodily injury; or
  4. He possesses any article used or fashioned in a manner to lead any person who is present reasonably to believe it to be a deadly weapon or represents verbally or otherwise that he is then and there so armed.

A BB gun is considered a deadly weapon under Colorado law because if a person is hit with a BB in a vulnerable area, like the eyes, that BB could cause serious bodily injury. Because the man presented a BB gun when allegedly committing the Robbery, his charge would be Aggravated Robbery.
