Private Labs are Testing Samples for DUI Cases in Weld County

Blood samples from DUI cases in Weld County and across Colorado are being tested at private labs in Colorado.

DUI cases in Weld County, Greeley and all Colorado may be impacted due to recent findings. Earlier this summer, it was discovered that there were errors being made at the state crime lab in the processing of blood samples for DUI cases throughout Colorado. According to a report from the Colorado Attorney General:

  • Employees at the state crime lab were making errors because they had been trained inadequately.
  • It was also revealed that many of the “experts” testifying in criminal cases across the state were not qualified.
  • Concern was also voiced that the former supervisor at the lab had a bias toward the prosecution.

In response to this breakdown of due process, 800 samples are being retested by private labs in an effort to ensure that the defendants in each of the cases receive accurate results at trial. Many DUI cases in Weld, Logan and Morgan County may have been affected.

Private Lab Testing: What is the Impact on DUI Cases in Weld County?

Private labs across Colorado are being inundated with samples: Many have rejected process requests because they are too busy, and others have begun hiring additional staff because of the increase in their workload (read more about private labs’ increase in staff on the Denver Post website). Law enforcement across Colorado say that they haven’t experienced delays in the tests that are being done at private labs, but that may not last. It is not clear when the state crime lab will end their suspension, and private labs don’t know if this increase will slow criminal cases throughout Colorado. The state crime lab will most likely end their suspension after the 800 samples have been retested. If it is found that the blood sample test results are different than the original result, people involved in DUI cases in Weld County may have their charges dismissed, or have their case thrown out because of the discrepancies in the test.
