(e)  A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

How is Public Indecency Sentenced in Windsor?

In Windsor, Public Indecency is generally sentenced as a class 1 petty offense. So, if you mooned someone, you would need to pay a fine of up to $500. And, you would also need to serve up to 6 months in Weld County Jail. However, you can receive a steeper sentence if it is your second Public Indecency offense for exposing yourself to alarm others in public. So if this was the second time this woman was charged with Public Indecency, and her first conviction was for subsection (e) above, she would face a class 1 misdemeanor instead of the petty offense. Additionally, she would also need to Register as a Sex Offender. A class 1 misdemeanor’s punishments are harsher than the petty offense’s. A class 1 misdemeanor is made up of: a fine between $500 and $5,000, between 6 months and 18 months in Weld County Jail.
