The Uber driver went around back and was trying to get in through the back door when the woman’s roommate foiled his plan. The man was arrested and is facing charges for Attempted Burglary.

A person commits second degree burglary, if the person knowingly breaks an entrance into, enters unlawfully in, or remains unlawfully after a lawful or unlawful entry in a building or occupied structure with intent to commit therein a crime against another person or property.

Factual or legal impossibility of committing the offense is not a defense if the offense could have been committed had the attendant circumstances been as the actor believed them to be, nor is it a defense that the crime attempted was actually perpetrated by the accused.

Basically, Attempt to Commit a Crime is charged when a person takes a significant step toward committing a crime in Weld, Morgan, and Logan County. Because the man was caught trying to open the locked back door, this would be considered a substantial step in committing the Burglary.
