James Holmes’ Journey though Colorado Justice System

Colorado was devastated last Friday morning by a shooting at an Aurora movie theater. Local media in Weld County and across cities like Greeley, Evans, and Hudson have provided relentless coverage and details of the shooting, the suspect, and the ongoing investigation.

The name “James Holmes” is everywhere. There are many different things that could be written in a criminal defense law blog about this subject. Out of respect for those killed, the victims that were injured, and friends and family members across Weld County, Colorado, maybe the best way to address this topic is to discuss the court proceedings, explain how the justice system works, and what happens to someone after they enter it.

At the O’Malley Law Office, we believe it is in the public’s best interest to be informed. Giving people more knowledge about Weld County courts and legal procedures in cities like Milliken, Keenesburg, and Platteville is a priority.

James Holmes’ first court appearance consisted of a short procedural hearing. In law terms, this first appearance is known as an advisement. The judge informed him of his rights and then ordered that he be held at Arapahoe County Detention Center without bond. The District Attorney, the person responsible for filing charges against those arrested, does not formally press charges against Holmes until the second court date.  This is always the first step when someone is arrested in Greeley or Weld County. A judge will advise the alleged offender of their rights. In this case, the district attorney wanted more time to investigate and then file charges, which can also happen in any case in Greeley or Weld County, especially high profile, serious cases.

It is important to know that even though defendants are entitled a speedy trial, the justice system is slow. The district attorney is already saying that if her office decides to pursue the death penalty, the whole process may take years. What an agonizing length of time for living victims and family of the deceased to go through.
