Kidnapping in Greeley | Noisy Neighbor No More

A man kidnapped his neighbor after she was being too noisy. He faces Kidnapping and Burglary charges.

Some people have very little tolerance for noise. One man took his intolerance to a new level, and his neighbors paid the price. According to the news report, the man was angry that his neighbors were making noise in the complex’s laundry room at 5:30 in the morning. So, he grabbed his gun and a baton and went next door to confront the noise makers. He allegedly grabbed his female neighbor out of her house and took her. The man took her to a dirt track where he made her walk around with him. He told her he was not going to hurt her, but he wouldn’t let her leave until he was done talking to her. The woman eventually told the man she needed to use the restroom and was able to get away and contact police. The man is being charged with Kidnapping and Burglary.

2nd Degree Kidnapping of a Neighbor in Weld County

Second Degree Kidnapping – C.R.S. 18-3-302 – is defined by Colorado law as:

(1) Any person who knowingly seizes and carries any person from one place to another, without his consent and without lawful justification, commits second degree kidnapping.

(2) Any person who takes, entices, or decoys away any child not his own under the age of eighteen years with intent to keep or conceal the child from his parent or guardian or with intent to sell, trade, or barter such child for consideration commits second degree kidnapping.

Kidnapping in the Second Degree is a class 3 felony in Weld, Morgan, and Logan County when the kidnapping is accomplished with the use of a deadly weapon. Because the man was carrying a gun when he grabbed the neighbor and then forced her to come with him, he would be charged with the class 3 felony. This level of felony is punishable by 4 to 12 years in the Colorado Department of Corrections.

1st Degree Burglary in Greeley

The definition of First Degree Burglary – C.R.S. 18-4-202 – according to Colorado law, is:

(1) A person commits first degree burglary if the person knowingly enters unlawfully, or remains unlawfully after a lawful or unlawful entry, in a building or occupied structure with intent to commit therein a crime, other than trespass as defined in this article, against another person or property, and if in effecting entry or while in the building or occupied structure or in immediate flight therefrom, the person or another participant in the crime assaults or menaces any person, the person or another participant is armed with explosives, or the person or another participant uses a deadly weapon or possesses and threatens the use of a deadly weapon.

(2) First degree burglary is a class 3 felony.

Interestingly, most people equate Burglary with Theft in Greeley, Erie, and Evans. They assume Burglary is only charged when someone breaks into a house to steal something. While that situation is considered Burglary, this crime is also charged when a person unlawfully enters or remains somewhere with the intent to commit another crime. Because this man entered the apartment with the intent to Assault and Kidnap the inhabitants using a deadly weapon, he would be charged with 1st Degree Burglary.
