Public Indecency in Weld County | Skinny Dipping Not Allowed

A man went skinny dipping in a hotel pool and now faces Public Indecency charges.

A man staying at a hotel decided to visit the pool, without a bathing suit. Apparently, he stripped down naked and got in the pool, where two teenage girls were also swimming. The two girls got out of the pool and called a parent to come downstairs to the pool. The parent asked the skinny dipper to put his clothes back on and a fight ensued. When authorities were called, the skinny dipper was back in his room and admitted to taking off his clothes, but claimed he thought the two girls were in their 30s. He was cooperating until they handcuffed him and tried to get him out of the room. He then began kicking the walls of the elevator as he was being taken downstairs. He was charged with Public Indecency and Resisting Arrest.

Public Indecency in Greeley and Windsor

Colorado law defines C.R.S. 18-7-301 – Public Indecency – as:

(1) Any person who performs any of the following in a public place or where the conduct may reasonably be expected to be viewed by members of the public commits public indecency:

(a) An act of sexual intercourse; or

(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or

(d) A lewd fondling or caress of the body of another person; or

(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

Because the man exposed himself and caused alarm to the two girls in the pool, he would be charged with Public Indecency. While a first offense is not considered a sex offense in Greeley, Erie, and Evans, a second or subsequent conviction requires a person to register as a sex offender.

Resisting Arrest in Weld County

C.R.S. 18-8-103 – Resisting Arrest – is defined by Colorado law as:

(1) A person commits resisting arrest if he knowingly prevents or attempts to prevent a peace officer, acting under color of his official authority, from effecting an arrest of the actor or another, by:

(a) Using or threatening to use physical force or violence against the peace officer or another; or

(b) Using any other means which creates a substantial risk of causing bodily injury to the peace officer or another.

When the man began to kick the elevator door and physically fight against the police officer, he opened himself up to be charged with this class 2 misdemeanor. In Weld, Morgan, and Logan County, this level misdemeanor is punishable with 3 to 12 months in Weld County Jail and up to $1,000 in fines.
