In Greeley and Weld County, Assault is a common Domestic Violence charge. There are three degrees of Assault a person can be charged with in Colorado: Assault in the First Degree, Assault in the Second Degree, and Assault in the Third Degree. When it comes to Domestic Violence, Third Degree Assault and certain subsections of Second Degree Assault are the most commonly charged crimes we’ve seen.

The Weld County, Colorado law definition of Assault in the Third Degree – C.R.S. 18-3-204 – is:

A person commits the crime of assault in the third degree if:

(a) The person knowingly or recklessly causes bodily injury to another person or with criminal negligence the person causes bodily injury to another person by means of a deadly weapon

In Domestic Violence cases, anytime an alleged victim claims that they felt pain because of physical contact with their significant other, then Third Degree Assault is charged. It is usually an allegation of hitting or pushing resulting in pain (bodily injury).

In Erie and Evans, Colorado, Assault in the Second Degree – C.R.S. 18-3-203 – as it relates to Domestic Violence allegations, is defined as:

(1) A person commits the crime of assault in the second degree if:

(b) With intent to cause bodily injury to another person, he or she causes such injury to any person by means of a deadly weapon; or

(d) He recklessly causes serious bodily injury to another person by means of a deadly weapon; or

(g) With intent to cause bodily injury to another person, he or she causes serious bodily injury to that person or another; or

(i) With the intent to cause bodily injury, he or she applies sufficient pressure to impede or restrict the breathing or circulation of the blood of another person by applying such pressure to the neck or by blocking the nose or mouth of the other person and thereby causes bodily injury.

While there are more subsections of Second Degree Assault, these are the four most commonly charged in Domestic Violence cases. Probably the most common allegation we see is charged under subsection (i) – a choking or strangulation allegation.
