In what the media is calling a polite bank robbery, a man handed a note to a bank teller that read:

I Need $150,000 Bands Right Now!! Please Police take 3 to 4 minutes to get here, I would appreciate if you Ring the alarm a minute after I am gone… make sure the money doesn’t blow up on my way out. : )

After getting the money he requested, he posted two videos of the bank robbery and a photo of the note and the money on Instagram. He was arrested less than 30 minutes later. While the man believes he did not rob the bank because he asked nicely and she chose to give him the money, he is still being charged with Robbery. He claims the teller could have just said no and he would have just left if she had.

Robbery in Greeley and Erie

C.R.S. 18-4-301 – Robbery – is defined by Colorado law as:

(1) A person who knowingly takes anything of value from the person or presence of another by the use of force, threats, or intimidation commits robbery.

(2) Robbery is a class 4 felony.

Now, here is where the man has a case. In order to be charged with Robbery in Greeley, Windsor, or Berthoud, two elements must be present:

  1. The accused takes something of value; and
  2. The accused uses force, threats, or intimidation.

The man did take something of value, but did he meet that second element? Where was the force, threat, or intimidation? He even used a little smiley face at the end of his note. It doesn’t seem very intimidating to me. But, if he is convicted of this crime, he could be facing 2 to 6 years in the Colorado Department of Corrections. That is why it is imperative he have an experienced criminal defense attorney, like those from the O’Malley Law Office, standing by his side in court.
