1. Weld County Courts Definition of Possession of Weapons by Previous Offenders, C.R.S. 18-12-108

At the Weld County Courts, the legal definition of Possession of Weapons by Previous Offenders, C.R.S. 18-12-108, is:

(1) A person commits the crime of possession of a weapon by a previous offender if the person knowingly possesses, uses, or carries upon his or her person a firearm defined in section 18-1-901 (3)(h) or any other weapon that is subject to the provisions of this article 12 subsequent to the person’s conviction for a felony crime as defined in section 24-4.1-302(1) or listed in subsection (7) of this section, or subsequent to the person’s conviction for attempt or conspiracy to commit a crime as defined in section 24-4.1-301 (1) that is a felony, pursuant to Colorado or any other state’s law or pursuant to federal law.

According to C.R.S. 18-12-108, a person convicted of a felony crime listed under this statute or in C.R.S. 24-4.1-302 cannot lawfully possess a firearm or other weapon.  You are also not permitted to possess or use a gun if you have been convicted of a misdemeanor crime of Domestic Violence.

2. Can I Get My Gun Rights Back in Fort Morgan and Eaton?

Many people in Fort Morgan and Eaton ask if their gun rights can be restored following a conviction of a felony offense or a misdemeanor Domestic Violence crime.  Understandably, they want to go shooting or use a firearm for self-defense, but do not want to be charged with a new crime.  Unfortunately, the answer is “not impossible, but highly unlikely.”  Firearm rights are a collateral consequence – a repercussion not imposed by the Larimer County Courts directly related to conviction of a crime.  Collateral consequences are notoriously difficult to have restored.  You can apply for relief or for clemency, but the likelihood of either application being approved is rather low.
