Right to Bear Arms: Obstruction of a Peace Officer in Weld County

If you're facing Obstruction of a Peace Officer charges in Colorado, call an attorney at the O'Malley Law Office today.

Our Right to Bear Arms is protected under the 2nd Amendment. This right is often under attack, however, as seen in a recent case that has captured the attention of many who fight to protect our gun rights.

Recently, a high school boy was charged with Obstructing a Peace Officer after an incident at school. The boy was wearing a National Rifle Association t-shirt that had an image of semiautomatic rifle on it along with the words: “Protect Your Right.” A teacher took offense at the t-shirt and its slogan (the school had no dress restrictions for a t-shirt with a gun on it), and demanded that he either take the shirt off, or turn it inside out. The 14-year old refused, and cited his first amendment rights. The teacher persisted in his request, and eventually school officials called the police. A police officer eventually arrested the boy, who continued to vocally assert his rights after being warned to be quiet. This resulted in the Obstruction of a Peace Offer charge.

Victory for the Right to Bear Arms

When the high school boy returned to school, he wore the shirt in protest. He was greeted with a show of support from his classmates – many of whom wore similar t-shirts. Support continued to flow in, and eventually the charges were dropped (both parties agreed to not pursue charges). This is fortunate, because the boy would have been incarcerated in a juvenile facility for his stance.

Here at the O’Malley Law Office we firmly believe in the Right to Bear Arms in Greeley, Windsor and all of Weld County. We have seen many attempts to deny this right, as in this case which resulted in the ridiculous charge against a high school boy.
