Greeley Theft Attorney
Woman Charged for Eating Deli Ham While at Work

A woman was charged with felony Theft for eating 3 to 5 pieces of ham every time she worked at the grocery store for 8 years.

Theft in Greeley and Weld County is taking something of value from another with the intention of never giving it back. A woman is facing Theft charges for eating deli ham while at work. According to the report, the woman worked at a grocery store and over an eight-year period would eat three to five pieces of ham each time she worked. Another employee reported the ham snacking and after investigating, it was determined that the Thefts equaled about a $9,200 loss for the grocery store. The woman was charged with felony Theft.

Weld County Theft Lawyer: How Can Multiple Thefts Be Charged as One?

At face value, it would seem that each Theft should be charged separately, meaning the woman would have thousands of charges for stealing a few cents worth of ham each time she worked. However, in Weld, Morgan, and Logan County, there is a provision in the Theft statute – C.R.S. 18-4-401 – that allows the state to charge multiple instances as a single count:

When a person commits theft twice or more against the same person pursuant to one scheme or course of conduct, the thefts may be aggregated and charged in a single count, in which event they shall constitute a single offense, the penalty for which shall be based on the aggregate value of the things involved, pursuant to subsection (2) of this section.

Because the woman allegedly stole from the same store more than two times, they can, and did, total up all the instances to charge as one Theft count.

Sentence for Ham Theft in Greeley and Frederick

Theft is charged as a petty offense, misdemeanor, or felony depending on the value of the items taken in Greeley, Frederick and Firestone. If they had charged the woman with numerous counts each time she ate some ham, she would have been charged with thousands of petty offense counts of Theft, because each time the Theft was less than $50. Because they totaled the amount, instead she would be facing the class 5 felony Theft. Can you imagine facing prison for eating a few pieces of ham? It seems a little over the top to me.
