Another Stuck in a Wall Story | Burglary in Greeley

I find it interesting that so many of these stories have been in the news lately (read our blog about the Longmont man stuck in a Marshalls wall), but here is another stuck in a wall story. Recently, a man was found in an apartment building laundry room taking quarters from a vending machine. When a resident caught the man, he blocked the door and began cutting through the drywall to try and escape. Unfortunately, he hit a brick wall, so he attempted to evade being caught by crawling through a vent. This did not end well for the man because he became trapped in the vent and had to call for help. The fire department responded and cut him free, but it was a short-lived freedom as he was arrested for Burglary.

C.R.S. 18-4-203 – Second Degree Burglary – is defined by Colorado law as:

“A person commits second degree burglary, if the person knowingly breaks an entrance into, enters unlawfully in, or remains unlawfully after a lawful or unlawful entry in a building or occupied structure with intent to commit therein a crime against another person or property.”

C.R.S. 18-4-204 – Third Degree Burglary – is defined as:

A person commits third degree burglary if with intent to commit a crime he enters or breaks into any vault, safe, cash register, coin vending machine, product dispenser, money depository, safety deposit box, coin telephone, coin box, or other apparatus or equipment whether or not coin operated.

There are two vital components needed to constitute 2nd Degree Burglary in Weld, Morgan and Logan County:

  1. Purposely breaking into, unlawfully entering, or illegally remaining in a building or dwelling; and
  2. The intent to commit another crime

This man could also be charged with 3rd Degree burglary because he entered or broke into the vending machine to get the quarters. This would likely be charged as a class five (5) felony under this statute.

In this case, as with many Burglary cases, the man unlawfully entered a building to commit a Theft. Theft tends to be the most common motivation for Burglary. This man went through a lot of trouble to commit a Theft – and it was just for a handful of quarters. The purpose behind his criminal episode may have been made clear when he was rescued. After the fireman asked if he needed medical attention, his response was ‘heroin.’ This might shed some light on why he thought it necessary to steal change from a soda machine and ended up trapped in a wall.
