Weld County 2nd Degree Assault (CRS 18-3-203) from a Brownie

Two University of Colorado students are facing multiple felony charges including charges of Second Degree Assault (CRS 18-3-203) after baking a batch of marijuana brownies to share in their history class. Even though the Colorado Governor just signed legislation legalizing marijuana in Colorado for Weld County cities like Greeley, Berthoud, and Erie, the district attorney in Boulder County insists that these students will face felony consequences for causing others to ingest marijuana without their knowledge.

Second Degree Assault is committed in Hudson, Keenesburg, and Miliken when someone injures someone else with a deadly weapon, prevents a police officer or firefighter from performing their job, or recklessly hurts someone else with a deadly weapon, OR if a person causes stupor, unconsciousness, or other impairment by a drug. This last clause would support this reefer case and result in harsh felony charges of Second Degree Assault. Even though marijuana is technically legal in Colorado as per Amendment 64 for adults 21 and over, it is still not acceptable to sneak it into “special” brownies and allow someone to eat them without knowledge that is contains a drug.

These students were not anticipating the seriousness of their actions when they decided to make these brownies, which also include the possibility of being expelled from the University of Colorado. Second Degree Assault is a serious felony crime and these students, one nineteen and the other twenty-one, will both be tried as adults and prison time is entirely possible. If they plead guilty or are convicted of a felony charge they will never be able to seal their criminal records and this will likely impact further education and job opportunities for a lifetime.
